If you're convicted of exceeding 90 mph in Fairfax County, the standard penalty on top of the fine is one day in jail for every mile per hour over 90. (I do not know this from personal experience but rather from having seen enough traffic court defendants sentenced over the years.)
Werth could potentially be looking at 15 days in there, especially depending on which judge he gets.
I did once see a judge ask a cop why he hadn't charged a guy with reckless driving for doing 98 in a 55 zone. The cop said (a) the guy was on I-66 west of Fair Oaks where it's wide and smooth, (b) there was a full moon and no clouds, (c) there were no other vehicles on the road, (d) the guy was driving a brand-new Corvette, so (e) the cop felt he was not endangering himself or anyone else and just had the understandable urge to see what his new car would do. The judge said "OK." I thought that was a pretty good exercise of discretion by the cop.
