This seems like a really unnecessary distraction though.   Internal investigation doesn't sound anything like typical outside the park legal issues.  Sign stealing is hot now, but are other teams canning coaches for that?   PED scandal?   Seems like there might be something more to this.

Go ahead and suspend Shue, the other hitting coach while you're at it. I'm thinking Dusty is partially to blame for resting these guys too much the last couple weeks........it's like they forgot how to hold a bat.

If the phone was issued by the Nats/included in his contract, or he shared the pics with someone on the team, the Nats could be partially culpable for not reporting it.

That's quite a leap from "included in his contract" and "shared pics" to Nats not reporting it. They would not be culpable for either of the first two, they would be if they knew about it and didn't report it (whether or not either of the first two were true) but how would they know about it? 
They are listed in the suit because of the possibility that it might be discovered that they knew about it.
