Thing is, that segment of the Beltway (the Toll Road north to the GW Parkway) has been under construction for most of this year. Lane shifts, narrower lanes than usual, ruts in the pavement where the lane markings used to be, inadequate shoulders, etc. They're converting the left shoulder to a part-time lane. Of all the places he could have picked to drive like that, he picked one of the dumbest ones.

I was in court representing a client on another matter once and I saw a judge handling a case where someone was pulled over for going 98 mph on I-66 west of Fair Oaks. The judge wanted to know why the cop didn't issue a reckless driving ticket, just simple speeding, and the cop said (a) it was late at night, (b) there was a full moon and dry weather, (c) there was no road construction and the road was in excellent shape, (d) there was nobody else on the road, and (e) the guy was driving a new Corvette so the cop felt he was just being an idiot to see what it could do rather than endangering himself and others. The judge accepted that. So there is some level of legitimate discretion involved. Werth just happened to pick a really stupid place to do it.

I think the Virginia reckless driving law is a bit of a "gotcha" law because it allows overzealous cops and judges to impose draconian penalties on you if all you do is go 81 mph in a 70-mph zone. While that CAN be quite dangerous in some circumstances (say, it's raining, you're speeding and weaving in and out with no signal and you illegally fail to use your headlights in the rain), I don't think it's INHERENTLY dangerous to go 81 in a 70 zone. But it's hard to say the same about 105 mph on that particular segment of the Beltway. Also, apparently he exited onto the GW Parkway and was going to continue flying along there. I'd argue that's even dumber.

I like Werth, but this was just a stupid thing to do.

This is a poor man's decision (a poor man can't afford to appeal) Werth isn't poor he'll appeal and get community service probably telling a bunch of third graders about bangibg Chase Utley's wife.

True. If the Park Police pull him over, the case goes to the Eastern District of Virginia (federal courthouse in Alexandria's Carlyle area). I've seen the magistrate judges there dealing with the traffic docket from the GW Parkway and the Pentagon. They don't have a lot of patience for most of it, especially if you're in front of Magistrate Judge T. Rawles Jones. He can be a nice guy OUTSIDE the courtroom.

Have you ever tried to do 105 in a Honda Civic? You'd need a mille of down hill and a good tail wind.  With a Prche....you wouldn't even need to fully depress the accelerator.

I'd be willing to bet it was him and the State Trooper on the highway at 0940 on the Sunday morning of the 4th of July weekend.

I believe it's Oregon that has replaced "Speed Limit" signs with "Speed" signs - it's a recommendation on roads other than interstates.

"Reckless" as a legal concept means acting with conscious disregard to your own safety and that of others. I think there's a reasonable argument that driving a new Corvette 98 mph on that particular segment of I-66 under those particular conditions posed no danger to either that guy's safety or that of others. I think, given the construction on the Beltway segment in question, the argument doesn't work nearly as well there.

Not that I know of. There is no court reporter in General District Court because it is a court not of record—if you appeal to the Circuit Court, you get a whole new trial. (Actually, there's only a court reporter in Circuit Court in Virginia if one of the parties hires one, which is asinine, but at least you CAN have a reporter there. In General District Court it's pointless to have one.)

Nope, he'd lose his license at worse. At least he was sober and honest. That goes a long way with Troopers. You bullcrap them and you'll get hammered.

"Reckless" can mean whatever a state wants it to mean.  If Virginia says that driving 105 constitutes reckless driving, then someone caught going 105 can be charged with reckless driving and the state has no burden to prove intent.
