Ah I was actually thinking of the cheesy but so catchy "Built this city on rock n roll"  :-[ but omgosh I loved Miracles, such a beautiful song.

Was that with or without Kantner by that time?  At some point, he split off from Jefferson Starship, Grace Slick continued, he sued over the use of the name "Jefferson" by a group without him in it (I think he and Grace had been the only members all the way through) so the group became simply "Starship."

Looks like it was without but surprisingly that silly song was co-written by Bernie Taupin and Peter Wolf (among a few others) it has a much better pedigree than I would've guessed :lol:

Shining Star into That's the Way of the World is just a great sequencing of songs.  Might even rank ahead of Dixie Chicken / Tripe Face Boogie on Waitng for Columbus or China Cat Sunflower / I Know You Rider on Europe '72.

going to guess that the Rs will do the Abe Fortas strategy and not allow Obama's nominee to be confirmed before the election. 

This will mean that the cases that would have gone 5-4 in favor of the conservative wing will now be 4-4, affirming the lower court, for the next year + .  I forget how long it took for Nixon to send up his first nominee for associate justice (Carswell or Haynesworth (?)).  Both of Nixon's first associate justice appointees were defeated - that seat eventually went to Blackmun - and that was before nominations started to routinely draw partisan nay votes.

Ironically, the court took a 5-4 action this past week, staying the Clean Power Plan (the CO2 limits on existing power plans).

because we have 3 threads talking about Scalia, I forget where I posted it, but 2 of the more controversial, likely to be 5-4 splits, were going to come out the 5th Circuit (Texas, Louisiana, Mississippi, and  maybe New Mexico) involving the Texas abortion restrictions and the immigration EO.  Those will likely be appeals of conservative rulings, so 4-4 or 5-4 is not much of a difference.  The cases I think that might be most immediately impacted will be some of the racial gerrymandering / civil right review cases like Virginia where the lower court found discriminatory motives in concentrating African American voters into one district to make the surrounding districts Republican-friendly.  A 4-4 affirms that the result below, and Scalia surely would have been a 5th vote.
