By that definition he would have to have violated some rule.   What rule would that be?

If there is proof that you bought a banned substance, you can get banned even without being tested positive. Apparently.

A few players who were suspended without failing a drug test
Jordan Schafer: http://sports.espn.go.com/mlb/news/story?id=3336898
Rick Ankiel: http://thesteroidera.blogspot.com/2007/09/rick-ankiel-received-human-growth.html

There are probably others, but these players seem to have a decent amount of evidence against them before being suspended. And it seems to be more/less "circumstancial" than the evidence against Gio.

The notes don't even really say anything.  I remember reading that the New Times had more names but weren't releasing them since they didn't think their 'evidence' was very compelling.  So does that mean that the notebook was filled with player stats like Gio's were written there?

I think there is enough smoke there that something untoward happened - especially with Gio having the relationship with the strength trainer.  But I don't think the notebook is enough for any kind of suspension.

Ankiel wasn't suspended

Shafer was a minor leaguer (no mlbpa)

Thanks, I thought I read somewhere that he was suspended.

I guess that the lack of an Ankiel suspension gives hope for Gio's case.

Franklin Morales being prepared to start in Red Sox training camp.

Quote
Alfredo Aceves and Franklin Morales will both come into camp as starting pitchers, a role Farrell said he expects Aceves to have for Mexico in the World Baseball Classic. “We’ll adjust from there,’’ he said.

Morales returned to Connecticut this week and his return to Fort Myers could be delayed by Friday’s blizzard, Farrell said, though he expects Morales back for Tuesday’s first official workout. Some staff members may also be delayed by the blizzard, he said.
We've discussed him as a potential lefty bullpen piece who could start if Gio is supended.
