They didn't have a choice since they offered him arby.  If Beinfest hadn't been an idiot, he would have been gone no later than the winter meetings and it have never gotten this far.

The are still trying.  It seems it would be easier to trade a contracted player than one who is the arby process.  It seems that the Marlins reporters are giving it a 50/50 that he'll still be around at the start of spring training, and a zero percent chance he's around after July 31.  Unfortunately, the writers are ignoring nobody else wants him at any price. So, if the Fish can find somebody more stupid than Beinfest, they'll likely have to eat most of the salary.  One thing you can count on with Beinfest is that any increase in payroll is probably going to be paying for players on other teams.

The arbitration itself does not have a bearing on termination pay.   The player must also show insufficient skills to play pro ball.  Paragraph B below is the one that applied to Sean Hill, and the termination was such that he was paid for 30 days.

ARTICLE IX—Termination Pay

A. Off-Season

A Player who is tendered a Uniform Player’s Contract which is subsequently terminated by a Club during the period between the end of the championship season and the beginning of the next succeeding spring training under paragraph 7(b)(2) of the Uniform Player’s Contract for failure to exhibit sufficient skill or competitive ability shall be entitled to receive termination pay from the Club in an amount equal to thirty (30) days’ payment at the rate stipulated in paragraph 2 of (1) his Contract for the next succeeding championship season, or (2) if he has no contract for the next succeeding championship season, in an amount equal to thirty (30) days’ payment at the rate stipulated in paragraph 2 of the Contract tendered to him by his Club for the next succeeding championship season.

B. Spring Training

A Player whose Contract is terminated by a Club under paragraph 7(b)(2) of the Uniform Player’s Contract for failure to exhibit sufficient skill or competitive ability shall be entitled to receive termination pay from the Club in an amount equal to thirty (30) days’ payment at the rate stipulated in paragraph 2 of his Contract, if the termination occurs during spring training but on or before the 16th day prior to the start of the championship season. If the termination occurs during
spring training, but subsequent to the 16th day prior to the start of the championship season, the Player’s termination pay shall be in an amount equal to forty-five (45) days’ payment at the rate stipulated in paragraph 2 of his Contract.

Cantu agrees on $6 million contract

The Marlins came to terms on a one-year, $6 million contract with slugger Jorge Cantu.

Retaining Cantu also was a high priority. The veteran will turn 28 on Jan. 30, and he's been one of the Marlins top run producers the past two years. In 2009, he collected 100 RBIs batting in the cleanup spot, behind All-Star Hanley Ramirez.

Cantu, who made $3.5 million in '09, can play either first base or third base. In Spring Training, prospects Gaby Sanchez and Logan Morrison will get a shot to win the first base job. If one of them does, Cantu projects to play third base. If neither prospect claims first base, then Cantu would be the front runner to play first.

In the first half of 2009, Cantu dealt with some injury and health issues. He played through a sore left hand, after being hit by a Daniel Cabrera fastball in the third game of the year. Before he was completely recovered, he went through stretches where his body was lethargic, a side effect created by medication he was taking for a cholesterol condition.

In the second to last game of the season, Cantu sprained his right ankle, and he spent a few weeks in a walking boot.

While Cantu's home run total was down from 29 in 2008 to 16 in 2009, he drove in more runs last year.

He was able to reach the century mark by driving in 25 after August.

Cantu added a career high 42 doubles, topping the 41 he hit in 2008.

I still can't believe Beinfest freaked up so royally have signed St. Claire, then to be stuck with Uggla, but to have signed Gregg would have constituted justifiable homicide on the three strikes and you're out policy.

In other bullpen news, while the Marlins did reach out to former closer Kevin Gregg, don't look for a reunion. Gregg has received more lucrative offers from other clubs and is believed to be close to signing with either the Rockies or Blue Jays.
