By that definition he would have to have violated some rule.   What rule would that be?
If there is proof that you bought a banned substance, you can get banned even without being tested positive. Apparently.

There are probably others, but these players seem to have a decent amount of evidence against them before being suspended. And it seems to be more/less "circumstancial" than the evidence against Gio.

The notes don't even really say anything.  I remember reading that the New Times had more names but weren't releasing them since they didn't think their 'evidence' was very compelling.  So does that mean that the notebook was filled with player stats like Gio's were written there? 

I think there is enough smoke there that something untoward happened - especially with Gio having the relationship with the strength trainer.  But I don't think the notebook is enough for any kind of suspension.

Thanks, I thought I read somewhere that he was suspended.

I guess that the lack of an Ankiel suspension gives hope for Gio's case.
